California trial courts defer to the "best interest of the child" when making child custody rulings. Continuous and frequent visits with both parents is the underlying public policy pursuant to California Family Code.
Custody is defined by legal and physical custody:
Legal custody is the ability to make decisions regarding a child's health, safety and welfare, including but not limited to, education and religion
Physical custody is the actual physical time allotted to each parent
Child Support is based on the parents' ability to pay, irrespective of actual time shared.
